Long-Term Disability Claims

Long-Term Disability Claims
In order to qualify, an employee must satisfy certain criteria that should be clearly stated in his or her employer's group policy manual. Most policies have two distinct qualifying disability definitions, over two periods:

The first period is generally the first two years of disability. During this time, the test for disability is whether or not the individual is able to perform the job he or she was doing at the time of sickness or injury.

The second period commences after two years. At this point, the employee must show that he or she is unable to perform any job for which he or she is able to perform, taking into consideration age, education and experience. Frequently, insurers deny benefits at the outset or at some period of disability, despite evidence from treating physicians that the employee is in fact unable to return to work.
In many instances, LTD claims are combined with or related to other litigation claims, like car accidents, workers' compensation claims and Canada Pension Plan appeals.
